Course Objective and Content

Course Objectives: Based on the discussions within the framework of feminist law, different equality debates within the framework of criticisms against formal equality and the possibilities of impartiality will be discussed with examples from national and international judicial decisions.
Course Content: In feminist legal debates, formal equality is treated as a liberal demand that sees men and women as equal legal beings and demands rights applicable to both. By basing equality on the sameness of the sexes, liberal feminists have tried to ensure that women leave the private sphere and enter the public sphere. Within the framework of formal equality, gender-based discrimination was rejected, the similarities between men and women were emphasized and equality before the law was demanded. However, even in cases where equality before the law is recognized, the practice of law emphasizes the "real" differences between the sexes, resulting in discriminatory practices. The differences between men and women are increasingly used in a way that leads to more ambiguous evaluations; this expression, which is used without discriminating between biological sex differences and cultural assumptions, renders the differences determined and imposed by cultural norms as natural distinctions and renders them immutable. Another criticism that can be brought to formal equality is that equal protection created within the framework of non-neutral regulations is doomed to failure within the masculine understanding of law. Based on these discussions within the framework of feminist law, different equality debates within the framework of criticisms against formal equality and the possibilities of neutrality will be discussed with examples from national and international judicial decisions.
