Course Objective and Content

Course Objectives: Environmental issues and climate change in particular have increasingly been occupying a substantial portion of international litigation. Various different legal tools and mechanisms have been developed in international law and human rights law forming an ever-expanding body of law. Exploring different international treaties and the relevant international and regional jurisprudence, this course will provide a foundation for using international law and human rights law mechanisms and legal tools of these disciplines for environmental protection.
Course Content: The course will offer an examination into the the utilization of complaints or litigation procedures to achive a legal development beyond the urgent demands of the individual applicant, i.e. the concept of strategic litigation in the environmental context. Through a presentation and active discussion of key cases, the course will include the analysis of current challenges faced in environmental litigation as well as possibilities and alternative routes offered by international law to overcome these challenges.
