Course Objectives: | In the course, the multidimensional character of law will be analyzed by making use of contemporary interdisciplinary studies on law and current legal debates will be discussed from this perspective. |
Course Content: | Although law is often seen as a normative structure separate from social reality, in essence it shapes human behavior and social reality and is an observable social phenomenon that is born and develops with society. In fact, confusion about legal analysis stems from the multidimensional character of law. At first glance, law is a "normative order". Every rule of law contains a positive norm, that is, a rule of behavior. Although the existence of a positive norm is a necessity for the concretization of law, law cannot be seen as consisting only of norms. The main function of law is to shape social life according to ethical principles. Therefore, it cannot be abstracted from its content and reduced to norms. Law is also an observable social phenomenon since it shapes human behavior and social reality, is born and developed together with society, and is dependent on the conditions of place and time like society. In the course, this multidimensional character of law will be analyzed by making use of contemporary interdisciplinary studies on law and current legal debates will be discussed from this perspective. |
